Can a 482 visa lead to permanent residency?

Temporary Skill Shortage (TSS) Subclass 482 Visa

When an Australian employer is unable to source an appropriate local worker for a particular skilled job post, the government has allowed employers to address the labour shortage by hiring overseas skilled workers and granting them a Temporary Skill Shortage Visa

With this visa, one can: 

  • Work in Australia within a certain duration
  • Travel to and from Australia as long as the visa is valid
  • If eligible, apply for permanent residence

The Short-term stream of the Temporary Skills Shortage (Subclass 482) visa allows for a duration of stay of up to 2 years, with the possibility of extension for an additional 2  years. In contrast, Medium-term stream visa holders can reside in Australia for up to 4 years. Moreover, Medium-term 482 visa holders are eligible to apply for the Permanent Visa via the Employer Nomination Scheme (ENS) Temporary Residence Transition Stream (TRT).

Permanent Residency in Australia

As a permanent resident in Australia, you are entitled to certain benefits, including an indefinite stay in Australia, enrollment in the national healthcare system, and eligibility for bank loans to purchase property, among other things. However, unlike Australian citizens, permanent residents cannot obtain an Australian passport, work for the Australian government, access student loans, or return to Australia without an active travel validity.

In March 2022, the Minister announced an expansion of the permanent residency stream, making it available for some Temporary Skills Shortage (Subclass 482) visa holders in the Short Term Stream to apply for the permanent visa if they are eligible under these temporary concessions that have been released.

Conditions include:

  • Applicants must be residing in Australia for at least 12 months between February 1st 2020 and December 14th 2021
  • Must be employed under an Australian business during the application period
  • Must meet the Employer Nomination Scheme (ENS) in the Temporary Residence Transition (TRT) stream requirements

Transitioning from TSS 482 Visa to Permanent Resident (PR)

One of the key requirements of applying for Permanent Resident status in Australia is meeting the health requirement. Additional eligibility criteria to consider when applying for a PR with a 482 visa are: 

  • Must have the same employer for three (3) years on the TSS 482 visa
  • Must meet minimum English proficiency standards
  • Must be under 45 years of age during the application for Permanent Residency

Applicants transitioning into Permanent Visa status can also include their dependent children, step-children, and partners in the application, following certain conditions.
